Terms and Conditions of Sale

Public Buying Power Limited (referred to as ‘Public Buying Power/PBP/we/our) present our website to the customer (referred to as ‘customer/you/your/their) for online usage subject to their agreement to be bound by our terms and conditions as detailed beneath. These terms and conditions equally apply to telesales taken through our customer care centre.

Our terms and conditions are subject to change with immediate effect. All customers will be asked to read and accept the terms and conditions prior to their order completion.

Order Procedure

• Please read our online ‘Help’ section on how to quickly, effectively place your order with PBP

• All orders processed using our website are done with your acceptance of our terms and conditions

• Once your order has been successfully processed, PBP will automatically email you with an order number and details of all products and charges placed

• Our acceptance of your order will only become contractually binding when we send our confirmatory, second email detailing delivery – please see our terms and conditions for delivery

• PBP may decline all or part off your order at our discretion prior to our acceptance – our second email to you will detail why

• All orders placed through PBP are maintained for a 12 month period: you may access your orders via My Account

Pricing and Payment

• All our product-pricing displayed includes VAT and is in pounds sterling

• Product-pricing is subject to availability and may change prior to us emailing you our confirmatory second email: if on the rare occasion this does happen, our second email will give detail

• Rarely, our product-pricing/description/availability maybe in error: therefore, you or we reserve the right to cancel a confirmed order with full or partial order refund. On our part, we’ll email you notification at the earliest opportunity

• Payment is accepted from most major Credit/Debit card companies as detailed at the bottom of our websites HomePage: PBP reserve the right, at our discretion, to retain a 2.6% handling charge per order total in respect to order/part-order Cancellation

• Title of any product sold through our website/telesales remains with PBP until both full order payment has been confirmed, and delivery taken by you: only from that point does Title of product pass to you

Account Balance Procedure

When you order any product from PBP before its sell period end, and the sell period end product price is less than that paid, you are entitled to receive an automatic electronic credit voucher, paid to your PBP account, subject to;

• We only make Account Balance payments to our customers 28 days after the purchased product(s) sell period end: this is to allow PBP to account for any potential returns on that product

• When further orders are processed, we automatically deduct any Account Balance credit from the order total first: any remaining charge must be taken from your Credit/Debit card as per any normal order

• At our discretion, PBP reserve the right to automatically remove any accrued Account Balance credit from your account if either, the account has been inactive for order purposes within any 12 month period or, if we suspect fraudulent behaviour: prior to the 12 months of inactivity we shall email you 1 month in advance as notification

• All electronic credit vouchers issued by PBP are for the sole use when ordering products through our website: they hold no monetary value whatsoever

Alerts Procedure

You may monitor any product presented on this website using our ‘Alert’ facility by email and/or SMS text. In doing so,

• PBP shall not be held liable or responsible for time delays and/or expense incurred when sending email and/or SMS text communication: you and your network provider shall be responsible for ensuring continued, reliable communications availability

• When using our SMS text Alert facility, PBP will charge a small fee over and above your normal network suppliers rate of charge – please contact our customer care centre for current pricing policy

Competition Procedure

PBP shall not be held liable or responsible for time delays and/or expense incurred when sending SMS text communication during our active Competition, or once Competition has closed. All participants must be aged 18 or over and of mainland UK residence

Customer Age Restriction of Sale

By ordering from PBP, you confirm your legal age to do so. Generally, all customers must have reached the minimum age of 18 years

Delivery

• Delivery charges and couriers used by PBP are detailed within our terms and conditions for delivery section:

pricing is automatically applied by our website, per order

• We try to ensure all orders are delivered to our specified timescales. PBP shall be under no liability for delay or failure to deliver the products within the confirmed timescale: we shall inform you of any delay by email

• You may use our website to perform online delivery tracking where applicable

• Title and risk (including damage) for all products passes to you once the product has been delivered

• PBP currently only delivers to mainland UK

Returns, Cancellations and Substitutions

Please read our returns and cancellation policy carefully, as outlined beneath:

Incorrect, Damaged or Missing Order Items:

You must;

• Notify PBP within 3 working days from date of delivery of any such product items that are incorrect, missing or damaged: either, email our customer care centre at customerservice@publicbuyingpower.co.uk or, write to our head office at the address given below detailing your order number and date of order

• PBP will issue you a returns number ready for collection where deemed necessary and at our discretion: under such circumstances, we shall be responsible for courier charges on our arrangement

• Maintain the products original packaging for re-packaging and the product must be complete and in ‘as new’ condition: we are unable to accept Software/CD/DVD items that have been unsealed where incorrectly ordered

Cancellation:

In accordance with your statutory rights regarding ‘The Consumer Protection (Distance Selling Regulations) 2000’ and the associated ‘Amendment 2005 ‘, you must;

• Notify PBP within 7 working days from date of delivery by email, fax or writing (see our customer care centre for details) detailing your order number, order date and reason for cancellation

• Maintain the products original packaging for re-packaging and the product must be complete and in ‘as new’ condition as if for sale: we are unable to accept software/CD/DVD items that have been unsealed

• PBP will issue you a returns number ready for collection where deemed necessary and at our discretion

• Exercising your 7 day right will mean PBP taking back the Title of the product if deemed in suitable condition to do so: it is your responsibility to fund the product delivery return charge and be liable for any ensuing damage during such procedure

• Product specifications (dimensions, weight, connectivity, etc.) may vary from the manufacturer during its production lifetime: PBP will endeavour to maintain our website information as accurate as possible and reserve the right not be held liable for such discrepancies

Substitutions:

Where a product item is deemed unavailable through manufacturer production or we are unable to deliver that item within our specified delivery timescales, PBP reserve the right to substitute that product for one of similar quality, specification and price, with your prior agreement.

PBP will;

• Inform you by email if such circumstances arise

• Offer you the right to cancel that order (or part-order)

• The substituted product item maybe subject to a differing sell period and therefore, differing Account Balance credit value – we will discuss this with you prior to agreement on substitution

• PBP will cover the delivery cost of returned Substituted item(s) should you decide they’re unacceptable, providing we arrange for their return

• Returning substituted item(s) remain your liability until returned and checked by PBP

Product Warranty:

All products supplied for sale by PBP are subject to their standard individual manufacturers warranty period and accompanying terms and conditions for warranty. Please note;

• Should your supplied product experience either a malfunction or technical problem within the designated warranty period, please call our customer care centre

• PBP reserve the right to exclude warranty claims where products have been deemed faulty through accident, neglect or misuse

• You will be liable for any collection charge and any unnecessary expense incurred where the product is confirmed fit for use as per described at time of order

Intellectual Property Rights:

You agree that all copyright and trademarks presented by our website, including content, products details and supplied Audio/Software titles, remain the legal property right of the relevant supplier/manufacturer/vendor/licensor. You are prohibited to use in any other manner except for your own personal, non-commercial/non-profit making use. Likewise, you further acknowledge and agree that all content and material of our website is strictly prohibited from being copied, translated or distributed for commercial gain.

General

• Your personal information entered into our website will be used in accordance with our Privacy Policy

• PBP can only accept the English Language as the means to conclude the contract

• Our Terms and Conditions Of Sale only apply to the PBP website: other, linked websites are governed by their individual Terms and Conditions of use of which you shall be bound

• PBP adhere to ‘The Consumer Protection (Distance Selling) Regulations 2000’ and its associated ‘Amendment 2005’: Code of conduct details can be found at;

• PBP shall not be held liable in whole or part for any loss of life, loss of personal possession/business and/or accident during supplied product installation, setup, operation and/or misuse

• You acknowledge and agree that all content and material of our website is strictly prohibited from being copied, translated or distributed for commercial gain

The contract between PBP and you shall be governed by the laws of England and all parties shall submit to the sole jurisdiction of the English courts.
